Acceptance of Terms of Use
Welcome to FWDFish.com (pronounced as Forward Fish dot com). FWDFish.com ("we", "us", "Site", "FWDFish", "Service", "Services") is owned and operated by TechForge Software Solutions Private Limited ("Company"). FWDFish.com provides its service to you ("User") under the Terms of Use described below.
Please read these terms of use carefully before using the services. By accessing this site or using any part of the site or any content or services on the site, you agree to become bound by these terms and conditions. If you do not agree to all the terms and conditions, then you may not access the site or use the content or any services in the site.
Changes to Terms of Use
FWDfish reserves the right, at its sole discretion, to modify or amend the Terms of Use at any time. You shall be responsible for reviewing and becoming familiar with any modifications to the Terms of Use.
In case there are major changes in the Terms of Use, FWDFish might post an announcement on the Site about the modification or amendments. However, posting of the announcement is at FWDFish's sole discretion.
Nature of Service and Content
Subject to full compliance with the Terms of Use, FWDFish may offer to provide certain services and content, as described more fully on the Site. The content of the Site is offered for general information, discussion, and entertainment purposes only. The content on the site and reflects the personal opinions of the users. You should be skeptical about any information on the Site because the information may be untrue, offensive, and harmful. You are invited to submit your email-forwards and other content on the Site and visit the Site. You are advised to review the User Conduct section fully before using the Site.
Your Registration and Obligations
In consideration of your use of the Service, you represent that you are not a person barred from receiving services under the laws of the Republic of India or other applicable jurisdictions. You also agree to provide true, accurate and current registration information about yourself. If you provide any information that is untrue, inaccurate, not current or incomplete, FWDFish.com has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete; FWDFish.com has the right to suspend or terminate your account and refuse any and all current or future use of the Service.
In order to register with FWDFish, you are required to select a user name and password and provide your email id, Name and other basic information.
You may NOT (1) select or use as a FWDFish Username a name of another person with the intent to impersonate that person; or (2) use as a FWDFish Username a name that is otherwise offensive, vulgar or obscene. FWDFish reserves the right to refuse registration of, or cancel a FWDFish Username in its discretion. You shall be responsible for maintaining the confidentiality of your FWDFish password.
Services are available only to individuals aged 13 years or older. However, children between the age of 13 and 18 years are strongly advised to get the consent of their parents or guardians before using the Site. If you do not so qualify, do not attempt to register for or use the Site.
User Conduct
As a condition of use, you promise not to use the Services for any purpose that is unlawful or prohibited by these Terms of Use, or any other purpose not reasonably intended by FWDFish.
By way of example, and not as a limitation, you agree NOT to use the Services:
1. to abuse, harass, threaten, impersonate or intimidate others;
2. to post or transmit, or cause to be posted or transmitted, any Content that is infringing, libelous, defamatory, obscene, pornographic, abusive, offensive or otherwise violates any law or right of any third party;
3. for any illegal or unauthorized purpose. If you are an international user, you agree to comply with all local laws regarding online conduct and acceptable content;
4. to post or transmit, or cause to be posted or transmitted, any communication or solicitation designed or intended to obtain password, account, or private information from any user;
5. to create or submit unwanted email ("Spam") to any other users or any URL;
6. to violate any laws in your jurisdiction (including but not limited to copyright laws);
7. to submit content or comments linking to affiliate programs, multi-level marketing schemes, sites/blogs repurposing existing content (source hops), or off-topic content;
8. with the exception of accessing RSS feeds, you will not use any robot, spider, scraper or other automated means to access the Site for any purpose without our express written permission. Additionally, you agree that you will not: (i) take any action that imposes, or may impose (in our sole discretion) an unreasonable or disproportionately large load on our infrastructure; (ii) interfere or attempt to interfere with the proper working of the Site or any activities conducted on the Site; or (iii) bypass any measures we may use to prevent or restrict access to the Site;
9. with the intention of artificially inflating or manipulating the rating of a post.
10. to advertise to, or solicit, any user to buy or sell any products or services. It is also a violation of these rules to use any information obtained from the Services in order to contact, advertise to, solicit, or sell to any user without their prior explicit consent;
11. attempt to impersonate another user or person;
12. sell or otherwise transfer your profile.
13. upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
FWDFish may remove any Content and user accounts, at its sole discretion. for reasons including, but not limited to, upon receipt of claims or allegations from third parties or authorities relating to such Content). The Site may also edit, refuse to post, or remove any posting at the Site's sole discretion. The Site reserves the right to restrict access by any users whom the Site believes, in its sole discretion, are engaged in inappropriate, unprofessional, or unlawful conduct. You are solely responsible for your interactions with other users of the Site. FWDFish reserves the right, but has no obligation, to monitor disputes between you and other users.
The User must REMOVE all email ids and personal information from a Forward/story posted by him. FWDFish will not be responsible for any misuse of the email ids or personal information posted in the Content by the User himself. The User will be responsible for any breach of his privacy or other's privacy that might occur due to this. FWDFish, at its sole discretion, might try to remove any such personal information from the Content.
Copyright Complaints
It is FWDFish's policy to respond expeditiously to claims of copyright and other intellectual property infringement. We will promptly process and investigate notices of alleged infringement and will take appropriate actions under the Information Technology Act of India 2000 (IT Act 2000) and other applicable intellectual property laws. Upon receipt of notices complying or substantially complying with the IT Act 2000, FWDFish may act expeditiously to remove or disable access to any material claimed to be infringing or claimed to be the subject of infringing activity and may act expeditiously to remove or disable access to any reference or link to material or activity that is claimed to be infringing. FWDFish will terminate access for subscribers and account holders who are repeat infringers.
To inform FWDFish about any infringement, you must provide complete information with reference to details of the pertinent Content and sufficient proof of how it infringes your copyright. You can email the information at admin@fwdfish.com.
Please also note that you may be liable for damages (including costs and attorneys' fees) if you materially misrepresent that an activity is infringing your copyright.

Termination
FWDFish may terminate or suspend any and all Services and your FWDFish account immediately, without prior notice or liability, if you breach any of the terms or conditions of the Terms of Use OR any governing law or policy. Upon termination of your account, your right to use the Services will immediately cease.
If you wish to terminate your FWDFish account, you may simply discontinue using the Services. All provisions of the Terms of Use which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
Miscellaneous
No agency, partnership, joint venture, or employment is created as a result of the Terms of Use and you do not have any authority of any kind to bind FWDFish in any respect whatsoever. The failure of either party to exercise in any respect any right provided for herein shall not be deemed a waiver of any further rights hereunder. FWDFish shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond its reasonable control, including, without limitation, mechanical, electronic or communications failure or degradation (including "line-noise" interference).
If any provision of the Terms of Use is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the Terms of Use shall otherwise remain in full force and effect and enforceable.
FWDFish may transfer, assign or delegate the Terms of Use and its rights and obligations without consent. The Terms of Use shall be governed by and construed in accordance with the laws of the Republic of India and the parties submit to the exclusive jurisdiction of the Supreme Court of India.
Trademarks
FWDFish, and other FWDFish graphics, logos, designs and service names are registered trademarks of FWDFish in the Republic of India and/or other countries. FWDFish's trademarks and trade dress may not be used, including as part of trademarks and/or as part of domain names, in connection with any product or service in any manner that is likely to cause confusion.
Licenses
In consideration for your agreement to these Terms of Use, the Site grants you a personal, non-exclusive, non-transferable, revocable license to access and use the Site. You may access the material on the Site only for your own personal, non-commercial use. The burden of determining that use of any information obtained from the Site is permissible rests with you.
By posting to or otherwise engaging in any communication within the Site, you are granting the Site (or any of its assignees) a perpetual, royalty-free, and irrevocable right and license to use, reproduce, modify, adapt, publish, translate, distribute, transmit, publicly display, publicly perform, sublicense, create derivative works from, transfer, and sell any such information.

FWDFish will not be responsible for any misuse of the email ids or personal information submitted in the Content by the User himself. FWDFish, at its sole discretion, might try to remove any such information from the Content.
Children Under 18 Years of Age
You must be 13 years and older to register to use the FWDFish website. As a result, FWDFish does not specifically collect information about children.

Laws and Regulations
FWDFish may be required by law to disclose your Personal Information to proper law enforcement agencies; upon receiving a formal request to do the same. In some cases, we may choose to buy or sell assets. In these types of transactions, user information is typically one of the business assets that is transferred.
